"RACINE -- A federal lawsuit claims white city officials in Racine discriminated against minority business owners. Recently released court documents show the city wants the lawsuit thrown out. This, as the president of Milwaukee's NAACP chapter is calling on the Department of Justice to investigate this case.

"'To me, that garners the NAACP's attention and it should garner the Department of Justice's attention,' Fred Royal with the Milwaukee NAACP said.

"The federal lawsuit was filed earlier this year against the city of Racine, alleging it unlawfully targeted minority business owners because of their race.

"Those with the group 'Racine Equality Project' believe the claim has merit.

"'I would be shocked if he didn't allow it to be used in the trial process,' Ken Yorgan with the Racine Equality Project said.

"However, attorneys for the city are asking that the case be thrown out -- saying in filed court documents: 'Plaintiffs' evidence of alleged racially discriminatory intent does not create a genuine issue of material fact.'"

The connections the couple made during that time convinced them to pull up their New York state roots and move to the city where Kherdian grew up in the 1930s and 40s.

"After Mayor John Dickert cast the tie-breaking vote rejecting the proposed CVS Pharmacy at Ohio Street and Washington Avenue, several readers contacted Racine County Eye asking why the store was turned away.

"The new store was planned at more than 13,000 square feet. A new CVS would have replaced its current store a half-mile east at West and Washington, and that store would close.

"CVS had an option to purchase the buildings housing Racine Cyclery, American Coin, the vacant building in between and the empty cash store next door to Racine Cyclery. The store also was going to buy at least three homes and level it all to make way for the new pharmacy and parking lot.

"In order to move forward with the project, the Common Council would have had to approve rezoning the parcels to a commercial designation. Several alderpersons opposed the change because the area is supposed to be a buffer zone between the commercial corridor on the west side of the intersection and the residential neighborhoods of Manree Park and West Racine to the east.

"After an August 3 vote denying the necessary rezone request, Alderman Henry Perez introduced a reconsideration measure, but it was defeated Sept. 1 with the 8-7 vote in which Dickert cast the tie-breaker.

"When Racine County Eye reached out to the mayor to ask why he voted against CVS at Ohio and Washington, he said it wasn’t to turn away a business with which the city wants to partner. Instead, it was about preserving the area as the buffer zone it was designed to be.

"'Look, I know people are disappointed, and I hope this isn’t the end of our discussions with CVS,' he said. 'But I voted "no" because I think we could have set ourselves up with a dangerous precedent that would have worked against us in the future.'

"Dickert pointed to the gradual transition along Washington Avenue from commercial to residential and how changing the rules for CVS could open up the 4300 and 4400 hundred blocks to more commercial development which would irreparably alter the neighborhood.

"Both of those blocks on the south side of the street each include one business and a handful of homes. The north side of the street is strictly residential.

"'What happens if we say "yes" to CVS and then other businesses want to come in and point to what we did there to support their requests to do the same on those other blocks?' Dickert added. 'The change to the neighborhood would be irreversible, and then we’d face similar situations in other areas of the city, and I don’t think, in the end, that our residents want that.'

"Perez – who represents the district that includes the proposed CVS site – disagrees with the mayor. He said he doesn’t see a dangerous precedent and said that was actually discussed early in the process with CVS, but didn’t see a problem because West Racine transitions into a solid commercial district betwesn Blaine and West Blvds."

"Man Arrested for Mocking Mayor on Twitter Wins Big in Civil Suit"

"An Illinois man who was raided and arrested last year for creating a parody account of his town’s mayor on Twitter has won $125,000 in a civil rights lawsuit settlement."

"Jon Daniel, 30, the man behind a parody Twitter account with the handle @peoriamayor, was accused of 'impersonating a public official,' after mayor Jim Ardis became upset about the mockery.

"'Im bout to climb the civic center and do some lines on the roof who's in,' one tweet read.  Another questioned, 'Who stole my crackpipe?'

"Ardis argued that these tweets sounded reasonable enough that it sullied his reputation, as people might not be able to tell the account was fake.

"'Hurt feelings do not free government from the responsibility of respecting Mr. Daniel's freedom of speech and freedom from being arrested for that speech,' ACLU attorney Karen Sheley said in a statement. 

"The settlement also includes the agreement that the town of Peoria will send a directive to the police department reminding them that parody and satire is excluded from criminalization under the impersonation of a public figure law.

"'The directive makes it clear that parody should never be the predicate for a criminal investigation and that the action against Mr. Daniel should never be repeated again,' Sheley stated.

"The agreement with the city will also cover legal fees, bringing the total taxpayer-funded cost of the raid to around $250,000."

"The deciding vote to reject once and for all a new CVS Pharmacy was cast by Mayor John Dickert.

"Despite his best efforts to get fellow alderpersons to reconsider, Henry Perez was unable to garner the necessary support to approve a new CVS Pharmacy at the corner of Ohio Street and Washington Avenue.

"The Journal Times reported that a vote was held Tuesday at the Common Council meeting and the proposed store was rejected again, but the original count of who fell on which side was unavailable. Wednesday afternoon, the newspaper listed Dickert’s vote as the tie-breaker.

"CVS was rejected 8-7.

"The new store was planned at more than 13,000 square feet and would have replaced its current store a half-mile east at West and Washington and that store would close.

"CVS had an option to purchase the buildings housing Racine Cyclery, American Coin, the vacant building in between and the empty cash store next door to Racine Cyclery. The store also was going to buy at least three homes and level it all to make way for the new pharmacy and parking lot.

"After an August 3 vote denying the necessary rezone request, Perez attempted to introduce a reconsideration measure, but because the discussion was not noticed on an agenda and wasn’t compelled by an alderperson who was on the winning side of the denial vote, the rest of the council could not legally address it.

"During the meeting Tuesday, Perez asked for a vote sending the matter to the Committee of the Whole, but board President Dennis Wiser instead directed the issue to a vote, the story continues.

"Perez and several other council members expressed concern about holding the vote so quickly because Jim Kaplan, a key supporter of the store, had to leave early and was unable to vote.  [My emphasis - Orbs]"

1. November 2008: An e-mail said President Obama would not be president for very long because “what black man holds a steady job for four years.”
2. March 2010: An e-mail mocked African Americans through a story involving child support. One line from the e-mail read: “I be so glad that dis be my last child support payment! Month after month, year after year, all dose payments!”
3. April 2011: An e-mail depicted Obama as a chimpanzee.
4. May 2011: An e-mail said: “An African-American woman in New Orleans was admitted into the hospital for a pregnancy termination. Two weeks later she received a check for $5,000. She phoned the hospital to ask who it was from. The hospital said, ‘Crimestoppers.’”
5. June 2011: An e-mail described a man seeking to obtain “welfare” for his dogs because they are “mixed in color, unemployed, lazy, can’t speak English and have no frigging clue who their Daddies are.”
6. October 2011: An e-mail included a photo of a group of bare-chested women dancing, seemingly in Africa, with the caption, “Michelle Obama’s High School Reunion.”
7. December 2011: An e-mail included jokes that are based on offensive stereotypes about Muslims.
There were other e-mails that showed “racial or ethnic bias, as well as other forms of bias,” the report states, but only these were included. The investigation did not find any suggestion that anyone involved in these e-mails were disciplined, nor were the e-mails reported or the people who sent them asked to stop. “Instead, the emails were usually forwarded along to others,” according to the report.

communist walk into a bar. The bartender asks ‘What can I get you Mr. President?’” (Id. at 21).
k. Wahlen’s e-mail to Officer Robert Purdy in which he refers to him as “Mumbai Bob” and asks “[a]re
you now wearing one of those towels on your head?” (Id. at 21).
w. E-mail from Wisneski to Helding with the subject line, “call a spade a spade.” (Id. at 22).
h. Deposition testimony from Penny Sharp that Mayor Dickert said “These niggers need to go back to
Waukegan because they are disturbing the revenue here in Racine from the lake, from our vacationers
at the lake.” (Id. at 19-20).
x. E-mail from Helding stating that the City was “turning into a Detroit.” (Id. at 30).
aa. E-mail from Helding to Maack in which he stated “Being an official, I feel like I have to restrain on
Facebook. Here is my comment on the Gnome. ‘They combine ghetto and trailer trash in a way that
hasn’t been seen since Eminem.’” (Id. at 21).
bb. E-mail from Wisneski to his mother concerning a bedspread for his son, stating “We will make sure
that your grandson gets a nice warm bead (sic) spread. The one he has now looks totally ghetto.” (Id. At
21). cc. E-mail from Wisneski stating “I have seen 2 Marcus signs, both in ghetto neighborhoods . . . .”
(Id. at 22).
r. E-mail from RPD officer David Smetana to RPD Lieutenant Macemon regarding Park 6 stating “[w]e will go ahead with the plan as we spoke of this morning including the nuisance property complaint and going after his cabaret license . . . Plan on proactive foot beats down there for the foreseeable future.”
s. E-mail from RPD officer David Smetana to Officer Wetzel stating “You may wish to check Park 6 and 2nd Time Around if Gingers is a bust. Happy Hunting, let me know how it goes.” (Id. at 28).
. E-mail from RPD officer Rick Geller stating “Alderperson Coe was present both nights and while happy with our efforts, has placed a target on Ginger’s as a result of the last few weekends.” (Id. at 28).
b. Devin Sutherland’s (“Sutherland”) e-mail stating that non-white establishments on 6th Street had “not added any value to the neighborhood.” (Id. at 6).
There were other e-mails that showed “racial or ethnic bias, as well as other forms of bias,” “Holmes vs The City of Racine” but only these were included. There are 350 additional emails yet to be released. There was not any suggestion that anyone involved in these e-mails were disciplined, nor were the e-mails reported or the people who sent them asked to stop. “
